The Declaratory Judgment Process
First, our lawyers will investigate if your insurance policy provided coverage for the claim that has been denied, or if the insurance company may have led the insured to believe their policy had more coverage than it actually did. Next, we will also look to see if the coverage was improperly denied. After that, we will help you evaluate and prepare a statement of loss. Finally, we will file a declaratory judgment, which is the main type of legal proceeding in insurance coverage litigation.
A declaratory judgment is a legal action where the plaintiff (in this case the insured whose insurance claim has been denied) is asking the court to determine what their legal rights are and who has a duty in this case.
Attorney Evan L. Goldman, who is certified by the Supreme Court of New Jersey as a civil trial attorney, and Robert L. Ritter have extensive experience in handling all types of insurance coverage disputes on behalf of both the insurer and the insured. Contact us
